12.06.2025 Regarding the order of Vijaya Karnataka Administrative Tribunal to limit reservation to 50% and urging the government not to implement the reservation report of Kantaraju / J.P. Hegde Commissions.
1) Karnataka State Administrative Tribunal (KAT) in Madhu Vs State of Karnataka Case dated 28.05.2025
a) Karnataka Government has cancelled the 56% reservation given in recruitment. Indira Sahani Vs Union of India A bench of 9 judges has ordered to limit reservation to 50%.
Government Order bearing No. 01 4 2022 dated 28.12.2022 has been cancelled. In this order, the reservation in the state of Karnataka was increased to 56 percent.
e) Already, the KPSC has partially cancelled the notification issued on 26.02.2024 for recruitment to various government posts and ordered to reduce the reservation from 56 percent to 50 percent.
Therefore, it is mandatory to limit the reservation to 50 percent in the state of Karnataka.Aadhaar number. Geo tagging of every household should have been done, this is not the case in the survey.
5. The decision to give 100 percent reservation to the Kuruba community like SC/ST is full of nepotism. This seems to be a conspiracy of the then Chairman of the Commission, Shri Kantaraju and the Honorable Chief Minister, Shri Siddaramaiah.
6. In the Muslim religion, about 100 castes have been classified and the population details have been given. But the details of their valuation have not been given. Out of these hundred castes, several castes belong to the upper castes and they should be excluded from reservation. In the Muslim religion too, some castes are socially and educationally backward, and a list of those castes should be made and reservation should be given to them. Therefore, giving reservation only in the name of the Muslim religion is unconstitutional and unscientific.
7. Giving more than 50 percent reservation is politically motivated. In 1992, the Supreme Court had ordered that reservation should not exceed 50 percent. But the government’s plan to provide more than 50 percent reservation is only to create desire among various classes and communities and mislead the people.
8. The Government of India is conducting the census and caste census this year itself, which will be a reliable data. Therefore, the outdated and outdated Srikantaraju/J.P. Hegde report should not be considered for any reason.
9. Since the social and educational survey conducted in 2015 is completely unscientific, we demand that the report submitted by the Backward Classes Commission be completely rejected and a caste census, social and educational survey be conducted scientifically.
Other demands of the Reservation Struggle Committee
1. Limit the total reservation to 50 percent and allocate reservation according to the population.
2. Extension of reservation for allotment of land in lease and KIADBs to Category-3A.
